Jan 26 ICJ preliminary ruling….

SOUTH AFRICA WINS AGAINST ZIONISM
But…
…no ceasefire, in practice.
Highlights:
🔹”The military operation conducted by Israel in Gaza has resulted in untold death and injuries, destroyed substantial infrastructure and housing units, caused mass malnutrition, collapsed the healthcare system, and displaced the majority of its inhabitants. This war has affected the entire population of Gaza and will have far lasting consequences. The court has taken note of the language of dehumanization by senior Israeli government officials.”

The ICJ accepts the South African demand for urgent provisional measures to be taken for the protection of Palestinians in Gaza against Israel and RECOMMENDS (caps mine) the following:
🔹”Israel must take all measures to prevent genocidal actions; Israel must ensure that its military forces do not commit genocidal actions; Israel must punish incitement to genocide; Israel must provide access to essential aid; Israel must preserve evidence of its actions; Israel must provide a report of its actions.”

The ICJ decision is BINDING.

Yet even as the ICJ decides that Israel must take all measures to prevent death and injury, and provide the full scope of humanitarian needs to Palestinians (includes access to food, medicine, infrastructure, etc), what happens if Tel Aviv simply ignores the decision?

Israel must file a report on the remedial actions within one month of the ruling. All bets are off on wether biblical psychopathology practitioners will comply.

France currently presides the UN Security Council.
Article 94.2 of the UN Charter:
By South Africa’s request, the UN MUST force Israel to apply the ICJ ruling.
Don’t count on trashy Macronist France to do the right thing.

International Criminal Court:
🔹’Israel’s actions in Gaza following October 7 may constitute genocide, with intent to destroy, in whole or in part, a particular ethnic group, the Palestinians’
🔹’There is an immediate risk of irrepairable harm to the Palestinians as an ethnic group’
🔹(provisional measures) Israel must immediately cease:
1. Killing members of the ethnic group (Palestinians).
2. Causing serious bodily or mental harm to members of the group.
3. Deliberately inflicting measures upon the group that could indirectly result in harm.
4. Preventing births from happening within the group.
The court orders Israel to report to the ICC within one month, to submit proof that it has taken the necessary action to abide by the measures as ordered by the court.
🔹– The court has ruled 15 to 2, that the State of Israel must immediately abide by all the provisional measures as ordered by the court.
– The court has ruled 16 to 1 that anyone who incites genocide against the Palestinian people must face immediate punishment by the Israeli authorities.
– The court has ruled 15 to 2 that the State of Israel must prevent the destruction, and commit to the preservation, of any evidence of its crimes against the Palestinians.
– The court had ruled 15 to 2 that the State of Israel must immediately stop any action that could possibly fall under the scope of genocide.

⭕ Israeli Analyst, Barak Ravid: ‘The spins about a ‘victory’ in The Hague are already starting. The very fact that merely 3 months after October 7th we were summoned (at the ICC) is a defeat in itself. The verdict of the court casts a heavy shadow on the judgement of the Israeli leadership. It will only increase the intl. pressure to end the war.’

Some Israeli media and government officials are spinning the story into a victory, due to the ICC did not directly complying with South Africa’s demand to call for an immediate ceasefire. Barak Ravid here explains why it is still a big slap in the face for Israel.
About the court case —>

Yes, it most likely means nothing in practical terms. Anyone who thinks Israel will listen to international law, is unfamiliar with both Israel and the so-called ‘international law’ that the hegemonic powers claim exists.

However, one thing is significant about this. It is now UNDENIABLE that Israel is committing a genocide. Even though it has not yet been officially proven, and it might never be (because they control the institutions), the ICC’s statements from today set an important precedent.

The Zionists can no longer laugh at us and call us biased, chew us up and spit us out for using the word genocide. Because genocide is what it is. And now, the highest legal institution in the world is finally starting to openly accept this fact.

In the end, there is a war on the ground, but there is also a war of rhetoric, a war of public discourse. Up until recently, the Zionists were undoubtedly winning the media war. But thank God, times have changed. And it won’t stop here.

The ICJ: A meaningless decision by a meaningless court

In one of the episodes of the British sitcom series “Peep Show”, Mark, one of the main characters, tells his friend “promise me you will not try to sleep with my sister”. In response, fully aware of his intentions, his friend says “I promise I will try not to sleep with her”. The next morning, after sleeping with Mark’s sister, he then says “I promised to try not to sleep with her, turns out it was literally impossible”. The subtle, yet important differences in meaning meant he, technically speaking, did as he promised.

I see plenty of people online celebrating the ICJ’s decision in the South Africa vs. Israel case. Anyone with any degree of experience with legal proceedings will tell you just how meaningless the provision is.

The court considers that with regard to the present situation, Israel must, in accordance with its obligations under the Geneva Convention, in relation to Palestinians in Gaza, take all measures within its power to prevent the commission of all acts within the scope of Article 2 of the Convention.

Just like Mark’s friend took all measures to prevent sleeping with his sister, so too Israel can (and will) “take all measures within its power” to prevent the committing of genocide, I have no doubt about it. South Africa also asked the ICJ to force Israel to provide a detailed report a month from now about the measures they applied. This too, I’m sure, Israel can do. Language is incredibly important in law. I wonder how the ICJ then plans to prove Israel didn’t take such measures? Even if Israel decides to accept the ruling (which they won’t and will probably call it anti-Semitic), they can say whatever they want and it won’t make any difference. They will simply come back to the ICJ a month from now and say they complied, doing “everything within their power” to prevent genocide – and they will be right, speaking in legal terms. Finding any amount of evidence to the contrary would take a thousand Jew lawyers a thousand Jew years to Jew-out. Feel free to watch the ICJ ruling in full here and listen carefully to the wording of provisions announced

Now let’s go a step further and assume the ICJ actually wanted to be a real court and decide that Israel must “immediately halt all operations against civilians and without delay cease any activities that put non-combatants in danger, including, but not exclusive to, attacks of any kind of civilian infrastructure in the sense set forth by the ICJ and the Geneva Convention” (or something along those lines). What stops Israel from simply refusing to comply? Israel, or any other country, can at any point claim the ICJ has no jurisdiction over them. Law compliance is only ever as strong as the ability of a court to enforce it. Therefore, even if Israel was clearly and without doubt ordered to stop doing whatever it is South Africa wanted them to stop doing, Israel can use that decision to eat their hummus off and nothing will change, because neither the ICJ, nor South Africa has any means to enforce the decision.

While the ICJ has theoretical jurisdiction and serves as an advisory body under the U.N., in practice its jurisdiction doesn’t leave the cafeteria. And yes, you can say that the U.N. members must comply because they are in the U.N., but reality is very different. These decisions and provisions are symbolic at best.

I will say it again, wording is very important when dealing with court cases and lawyers (especially lawyers). It is particularly important for the prosecution. If South Africa, for example, was to come back a month from now and say Israel didn’t comply with the court’s decision, Israel can come back with “we did, the court ruled we must do everything within our power, we did, hence complying with the court” and they would be right. Israel isn’t exactly knows for its good nature either.

So yes, congratulations, Israel will now do everything within its power to avoid committing genocide, it’s just they’ll find it impossible to do in the end.
