Under title 10 USC in wartime the army of the united states is the inactive (and active) militia, inactive which is, iirc, defined as males 17 to 70..but the definition may be changed by Congress/Senate…and it might be a lower upper number at this time… So? Well one might wring from the tortured legal realm a claim that any male is in the militia…and thus liable to court martial … Interestingly, by the way, similar logic could be used to prohibit guns to non-militia, and regulate guns in the militia…for example one might be required to possess a particular weapon and ammunition, and also be limited to that weapon… I don’t believe their lordships have realized this, yet. I admit it’s a bit of a long reach…but it’d be in character. Claiming war would also open the avenue to requiring muster, and a corvee en mass.
