⭕ ⚡️🇵🇸 The International Court of Justice (ICJ)  is set to give out an interim verdict after South Africa filed a case against Israel, accusing it of carrying out a genocide in the Gaza Strip, where they will decide on emergency and provisional measures against Israel in said verdict.

The court will NOT decide whether Israel is carrying out a genocide against Gaza, merely announce whether it can order emergency or provisional measures in Gaza, while it deliberates on whether Israel is committing genocide in Gaza, which could take another two or three years. South Africa has asked for the ICJ to order a series of measures to be taken in order to prevent violence in Gaza until the court can reach a decision. They include:

– Israel suspends all military operations in Gaza.
– Israel’s military organisations not escalate any military operations any further.
– Israel allow access to food, water, fuel, shelter, hygiene, healthcare and sanitation to the Palestinians.
– Israel prevents destruction of Palestinian life in Gaza.
– Israel not to destroy any evidence relevant to South Africa’s genocide case against it, and cannot deny international organisations such as fact finding missions to Gaza to help preserve the evidence.

So, what could happen? In the first instance, the case could be dismissed entirely, as Israel claims that the court has no jurisdiction over the case due to Israel’s claim about South Africa not effectively communicating with Israel about the case before filing the application to the court, as is required by the court’s own rules. If the ICJ announces that this matter is out of their jurisdiction, then South Africa’s requests become completely immaterial.

In the second instance, the court could order no measures would be taken, which is unlikely given the scenes of the on ground situation in Gaza. However, even if the court does not order any measures to be taken, this would not mean the end of the entire case, and the allegation of genocide against Israel will be still taken under consideration.

In the third instance, the court could order some or all of South Africa’s demands to be applied. Or they could completely disregard South Africa’s requests and order entirely different measures determined by the court itself. This is the more likely scenario.

However, whether or not this ruling will make a difference is an entirely different story. Israel can simply decide not to take any measures ordered by the court, whereupon a member of the United Nations Security Council (UNSC) member can take this matter to the council and vote on a resolution requiring Israel to abide by the measures ordered by the court, but that resolution would most likely be vetoed by the United States and thus rejected. So, to answer the question, “will this really make a difference for Gaza?” Most likely, no.
